2. Description of Service

Breezy Tweak is a web-based image processing application that provides tools for:

• Image resizing and cropping
• Background removal
• Color editing and detection (including Pantone color matching)
• AI-powered image enhancement
• Vector conversion
• DPI adjustment and other image manipulation features

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. User Accounts

To access certain features, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Subscription Plans and Billing

Breezy Tweak offers the following subscription tiers:

• Trial: 7-day free trial with full access to all features
• Pro: $10/month or $102/year (15% savings) - 25 operations per month, no vectorization
• Business: $20/month or $204/year (15% savings) - Unlimited operations, all features

Refund Policy: Due to the digital nature of our service, we generally do not offer refunds for subscription payments. However, if you experience technical issues that prevent you from using the service, please contact us within 7 days of your payment, and we will work with you to resolve the issue or provide a refund at our discretion.

5. Acceptable Use

You agree NOT to use the Service to:

• Upload, process, or distribute illegal, harmful, or offensive content
• Process images you do not have the right to use
• Infringe on copyrights, trademarks, or other intellectual property rights
• Transmit viruses, malware, or other malicious code
• Attempt to gain unauthorized access to our systems
• Use automated systems (bots) to access the Service without permission
• Resell or redistribute the Service without authorization
• Interfere with or disrupt the Service or its infrastructure

6. Intellectual Property

Your Content

You retain full ownership of any images you upload to Breezy Tweak. By uploading images, you grant us a limited license to process and display your images solely for the purpose of providing the Service. We do not claim ownership of your content.

Our Content

The Breezy Tweak name, logo, website design, and all software, features, and functionality are owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of our Service without written permission.

Third-Party Trademarks

Pantone® is a registered trademark of Pantone LLC. Madeira® and UltraColor® are trademarks of their respective owners. References are for identification and comparison purposes only. No affiliation or endorsement is implied.

Color Matching Disclaimer

Color values and cross-system matches are interpretive approximations provided for reference only. Third-party color system references do not imply endorsement, certification, or affiliation.

Color appearance may vary based on device, display settings, calibration, and output method. Automated color detection and conversion are provided as approximations, and differences may occur between on-screen previews and final printed or produced results. Users are responsible for verifying color accuracy prior to production or commercial use.

7. Third-Party Services

Our Service integrates with third-party services including:

• Google Firebase: Secure authentication and credential management - your login is protected by Google's enterprise-grade security infrastructure
• Stripe: Payment processing
• Resend: Email delivery

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• The quality of any products, services, or information will meet your expectations

We do not guarantee any specific results from image processing operations.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of profits, data, or business opportunities
• Damage to your images or files
• Service interruptions or downtime
• Errors in processed images

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Breezy Tweak and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of third parties
• Content you upload or process through the Service

11. Account Termination

We may suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Non-payment of subscription fees
• Extended periods of inactivity

You may delete your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the appropriate courts.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Breezy Tweak regarding the use of the Service, superseding any prior agreements.
